How do I file for bankruptcy without an attorney?

Ruby Norta Gumapac Assistant at Ascent Law LLC

While it’s possible to file for bankruptcy without an attorney in some states, it’s not recommended. The process can be complicated and can cause you to make mistakes that can cost you a lot of money. In some cases, a bankruptcy trustee can help you file without a lawyer. However, you may not know what you’re doing and you could end up making a lot worse decisions than you already are.

Even though filing for bankruptcy without an attorney can save you money, you should have an attorney to represent you at the meeting of creditors and confirmation hearing. You’ll also need a debtor education course to prepare for the bankruptcy process. If you don’t have the funds to hire an attorney, you can still file for bankruptcy if you’re eligible. You can file for personal bankruptcy under Chapter 7 or a business bankruptcy under Chapter 13.

State-level rules for filing bankruptcy without an attorney

Filing bankruptcy without an attorney is possible but requires a lot of patience and preparation. While Chapter 7 cases are easier to file without an attorney, few people have been successful in filing Chapter 13 cases on their own. Before filing for bankruptcy, you should learn all the state-level rules and requirements.

Exemptions from creditors in Chapter 7 case

Exemptions from creditors in Chapter 7 bankruptcy cases help debtors protect property they need to survive. Most bankruptcy cases have no assets at all, so exemptions allow debtors to keep the things they need for their daily lives. For example, they can keep clothing and other personal effects that have little resale value.

In a Chapter 7 bankruptcy case, the trustee will not be able to sell any property that is protected under bankruptcy exemptions. It is important to understand that the rules about exemptions in bankruptcy cases vary from state to state. State laws will determine what types of property are eligible for exemption.

Cost of filing bankruptcy without an attorney

If you decide to file for bankruptcy on your own, you can save money on attorney fees by not hiring one. Generally, bankruptcy attorneys charge a minimum of $3,500, but fees can be significantly higher or lower depending on the complexity of the case. A pro se bankruptcy attorney will usually charge around $350. However, bankruptcy attorneys may be willing to negotiate a payment plan that will fit your budget.

Costs for Chapter 7 bankruptcy cases vary from $1,000 to $3,500 depending on the attorney’s experience and the size of the firm. As a rule, larger firms and large metropolitan areas will charge more than a solo practitioner. However, the fees may be lower if your case is simple and you have no assets to protect. Solo practitioners may cost more, but will provide you with more personal service.
