An insolvency and bankruptcy lawyer deals with the various stages of insolvency. He or she negotiates company voluntary arrangements and other forms of restructuring, as well as administration, receivership and liquidation, which involves taking assets to pay off debts.

Insolvency lawyers can work for a wide variety of firms. Larger City firms tend to act on behalf of banks and other large institutions, while smaller firms are usually more likely to represent individuals in financial trouble.

Insolvency

An Insolvency and bankruptcy lawyer is someone who works in the field of bankruptcy law. They advise companies and banks on how to deal with financial difficulties. Bankruptcy lawyers also help distressed businesses and companies resolve disputes with their creditors. They have extensive experience in complex bankruptcy litigation and restructurings. Some of them have worked with multinational companies and have cross-border experience.

Insolvency can be a serious problem for a country. It occurs when it is not able to meet its obligations and defaults on its debt. It is a legal situation that can happen to any country, including those in the European Union. In Canada, for instance, over 8,409 consumers declared bankruptcy in 2011. Many people fear bankruptcy because they perceive it as failure. After all, filing for bankruptcy means losing everything you’ve worked so hard to build.

Restructuring

Insolvency and bankruptcy attorneys are highly experienced in the development of creative solutions for companies that face a variety of problems. They bring a broad range of experience to difficult situations and work closely with clients in different industries to deliver commercially advantageous outcomes. Examples of their work include representation of timeshare developers in bankruptcy proceedings, global financial services companies in insolvency proceedings, and technology companies in restructuring matters.

Restructuring often requires extensive negotiation. The number of parties involved in the case can be vast, and many of them have competing interests. This can make it extremely difficult to act on behalf of the debtor. The bankruptcy lawyer needs to be able to manage multiple stakeholders and make sure that all parties receive a fair share of the pie.
